TERMS OF SERVICE (PUBLIC OFFER)

This Terms of Service Agreement (“Agreement”) constitutes a legally binding public offer by DG Market, LLC, (“Seller,” “we,” or “us”), to sell digital products through https://mydgmarket.com (“Site”). By placing an order, you (“Buyer,” “Customer,” or “you”) accept these terms unconditionally.
1. General Provisions
1.1. This Agreement governs the sale of digital products (e.g., software, e-books, licenses) and supersedes any prior agreements.
1.2. By completing a purchase, the Buyer confirms they are at least 18 years old (or the age of majority in their jurisdiction) and agree to these terms.
2. Order Process
2.1. Offer Acceptance:
- The Buyer’s order submission constitutes an acceptance of this public offer.
- The Seller reserves the right to reject orders for any reason (e.g., fraud, incorrect pricing).
2.2. Delivery:
- Digital products will be delivered instantly via email/download link after payment confirmation.
- The Buyer is responsible for providing a valid email address and ensuring delivery (e.g., checking spam folders).
3. Pricing & Payment
3.1. All prices are listed in USD and exclude applicable taxes (if any).
3.2. Payment is processed through secure third-party gateways (e.g., Stripe, PayPal). The Seller does not store payment details.
4. Refund Policy
4.1. Due to the nature of digital goods, all sales are final unless:
- The product is defective (e.g., non-functional license key).
- The purchase was unauthorized (fraudulent charge).
4.2. Refund requests must be submitted within 7 days of purchase via sales@mydgmarket.com.
5. Intellectual Property
5.1. The Seller retains all copyrights and licenses. Purchased products are for personal/non-commercial use unless specified otherwise.
5.2. Prohibited: Redistribution, resale, reverse engineering, or unlawful use of digital products.
6. Limitation of Liability
6.1. The Seller is not liable for:
- Indirect damages (e.g., lost profits) arising from product use.
- Issues caused by the Buyer (e.g., incorrect system requirements).
6.2. Maximum liability is limited to the purchase price of the product.
7. Dispute Resolution
7.1. Disputes shall be resolved through negotiation or, if necessary, in courts of the State of Maryland, United States, governed by U.S. law.
7.2. EU consumers may pursue remedies in their local jurisdiction.
8. Force Majeure
The Seller is not liable for delays/failures caused by events beyond reasonable control (e.g., natural disasters, payment processor outages).
9. Amendments
9.1. The Seller may update these terms; changes take effect upon posting on the Site.
9.2. Continued use of the Site constitutes acceptance of revised terms.
